Recent examples of our work in this area includes:

  • Acting successfully in the leading Cayman Islands case on an Insurance Policy Avoidance claim concerning the interpretation of Aviation Insurance Policies. The matter involving analysis of mainstream policy terms such as a Law Compliance Condition, a Financial Cause Exclusion, a Claims Procedure Condition and a Loss Payee Clause. The matter also related to the Policy’s Due Diligence Condition and, Illegal Use Exclusion.
  • Acting for a number of Cayman Islands-based insurers in defending multiple claims.
  • Advising a UK-based reinsurer on their potential liability in relation to a claim by a hotel chain for business interruption losses arising from the COVID-19 pandemic.
  • Advising a company director who was the subject of a potential claim on the prospects of recovering his legal fees under his D&O policy.
